Victories
The following is a list of some of Ms. George's noteworthy cases:
Criminal:
2007 – Fields v. State – Ms. George successfully obtained a reversal of Mr. Fields conviction for Unlawful Delivery of a Controlled Drug and a remand for a new trial because Mr. Fields was forced to represent himself at his jury trial without being properly and sufficiently advised regarding the disadvantages of self-representation in violation of his Sixth Amendment right to counsel.
2006 - Willingham v. State – Ms. George successfully obtained a modification of Mr. Willingham’s sixty year sentence to twenty years based upon the policy of the trial court not to consider concurrent sentencing for defendants who exercise their constitutional right to a jury trial. Ms. George persuaded the appellate court that such a policy constitutes an absolute violation of a defendant’s constitutional right to jury trial under both the federal and state constitutions.
2006 – Wade v. State – Ms. George successfully obtained a reversal and complete dismissal of Mr. Wade’s embezzlement conviction based upon the failure of the prosecution to present sufficient evidence at the jury trial to support such conviction.
2006 – Nedd v. State – Ms. George successfully persuaded the appellate court to grant Ms. Nedd a modification of the revocation of her two year suspended sentence by granting her credit for time served.
2006 – Moore v. State – Ms. George successfully persuaded the appellate court to remand for re-sentencing Mr. Moore’s sentence of life without parole for the offense of First Degree Murder based upon faulty jury instructions. On remand to the trial court, Mr. Moore received a sentence of life with the possibility of parole.
2003 – Modesto v. State – Ms. George successfully assisted in obtaining a reversal and complete dismissal of one of Mr. Modesto’s two counts for Trafficking in Illegal Drugs because his conviction for both counts constituted a violation of Mr. Modesto’s right to be free from double jeopardy.
Civil:
2008 – Fox Flite v. XL Specialty – Ms. George successfully persuaded the Oklahoma Court of Civil Appeals to reverse a jury verdict finding a breach of contract and bad faith and to remand the case to the trial court for a new trial based upon faulty jury instructions.
2007 – Rogers v. Brown - Ms. George successfully defended in the Oklahoma Court of Civil Appeals and in the Oklahoma Supreme Court the order of the trial court granting custody of minor child to the mother.
2005 – In the Matter of the Estate of Kenneth Brown – Ms. George assisted in bringing an interlocutory appeal before the Oklahoma Court of Civil Appeals and successfully persuaded the appellate court to reverse the trial court’s order granting summary judgment for the opposing party.
